In “Justice and the State,” Rushdoony argues that the modern state has become an openly religious institution, replacing God with itself as the ultimate source of law, morality, and justice, so that whatever the state legalizes is declared moral and whatever resists it is condemned as evil. Once justice is identified with the will of the state, there is no higher law by which rulers, courts, or policies can be judged, and total power becomes necessary to achieve the “just society,” whether through Marxist terror, fascist coercion, or democratic indoctrination. This logic explains the growing hostility to Christian schools and to the church’s prophetic calling, since obedience to God’s law exposes the state’s claim to ultimacy as idolatry. When legality replaces righteousness, free speech, religious liberty, and moral witness collapse, and resistance to unjust laws is redefined as immorality. Rushdoony insists that there is no escape from this tyranny except the restoration of Christ’s lordship as Savior, Lawgiver, and King, for only when justice is grounded in God’s law can freedom, accountability, and true righteousness endure.
